Terms of Service

1. Agreement to Terms

By signing up for ShopGrow services or accessing shopgrowapp.com, you agree to these Terms of Service. These terms form a binding agreement between you (the shop owner or authorized representative) and KKV Labs LLC ("ShopGrow," "we," "us"). If you do not agree, do not use our services.

2. Services

ShopGrow provides done-for-you customer retention services for independent auto repair shops, including:

  • Automated SMS service reminders
  • Google review collection via SMS
  • Booking confirmation and follow-up messages
  • Dormant customer reactivation campaigns
  • Weekly performance reports

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.

3. Fees and Payment

  • A one-time setup fee of $1,000 is due before service commences.
  • A recurring monthly fee of $249/month is billed on a month-to-month basis.
  • Payments are non-refundable except as outlined in our 90-Day Guarantee (Section 5).
  • Failure to pay may result in suspension or termination of service.

4. Cancellation

You may cancel your monthly subscription at any time by notifying us at hello@shopgrowapp.com. Cancellation takes effect at the end of the current billing period. The one-time setup fee is non-refundable after services have been delivered, except under the 90-Day Guarantee.

5. 90-Day Money-Back Guarantee

If you do not see at least a 15% increase in returning customers within 90 days of your service launch date, you are eligible for a full refund of all fees paid. To claim a refund:

  • You must have provided a complete and accurate customer list at the start of service.
  • You must not have cancelled service during the 90-day period.
  • You must submit a refund request within 30 days of the 90-day period ending.
  • We reserve the right to review your account data to verify eligibility.

6. Your Responsibilities

By using ShopGrow, you represent and warrant that:

  • The customer data you provide to us was collected lawfully.
  • Your customers are existing customers of your business.
  • You have the right to authorize ShopGrow to send messages on your behalf.
  • You will not use ShopGrow to send spam, illegal content, or messages that violate TCPA or any applicable law.

7. TCPA Compliance

ShopGrow manages opt-out requests on your behalf. All messages include a compliant opt-out mechanism. You agree not to attempt to override opt-outs or re-add contacts who have opted out. Violations of TCPA that arise from inaccurate or unlawfully obtained data you provide are your responsibility.

8. Intellectual Property

All content, branding, and technology associated with ShopGrow is owned by KKV Labs LLC. You may not copy, reproduce, or use our materials without written permission. Customer data you provide remains your property.

9. Limitation of Liability

To the maximum extent permitted by law, KKV Labs LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of ShopGrow services. Our total liability to you shall not exceed the total fees paid by you in the 3 months preceding the claim.

10. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

11. Changes to Terms

We may update these terms from time to time. We will notify active clients of material changes via email at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance.
